Terms
These Terms govern access to and use of GrowthProof, a service operated by Shawal Kabir Chy, trading as GrowthProof.

Agreement and service
- GrowthProof is offered for business use by MSPs and other organizations, not for personal, family, or household use.
- A person who creates an account or purchases a subscription for a customer represents that they have authority to bind that customer to these Terms. Authorized users must comply with the provisions that apply to their use.
- GrowthProof helps MSPs collect evidence, manage client workspaces, and publish client-ready reports.
- Users are responsible for the accuracy of evidence, report content, client access decisions, and account activity.
- GrowthProof does not certify compliance, provide legal advice, or replace a professional compliance review.
Accounts and acceptable use
- Accounts must use accurate contact information and must not be shared outside the authorized team.
- Users must not upload unlawful content, malware, passwords, private keys, payment-card data, or data they are not authorized to process.
- Without a separate written agreement, customers must not use GrowthProof for health information, biometric data, government identifiers, children's data, or other regulated or sensitive data requiring safeguards the service does not expressly support.
- Users must not probe or bypass security controls, disrupt the service, impersonate another person, scrape the service, or use GrowthProof to infringe privacy or intellectual-property rights.
- GrowthProof may suspend access for abuse, security risk, non-payment, or violation of these terms.
Customer data and confidentiality
- Customers retain ownership of content they submit and grant GrowthProof the limited rights necessary to host, process, back up, transmit, and display that content to provide the service.
- Customers are responsible for obtaining all notices, permissions, and legal bases required to process client and user data through GrowthProof.
- The Data Processing Addendum is incorporated into these Terms and applies when GrowthProof processes customer personal data on the customer's behalf.
- Each party must protect the other's non-public confidential information and use it only to perform obligations relating to the service, except where disclosure is legally required.
Billing, renewal, and cancellation
- Paid subscriptions are sold and processed by Lemon Squeezy as merchant of record. Subscriptions renew automatically for the billing interval shown at checkout until canceled.
- Current prices, included workspace limits, billing interval, and applicable taxes are displayed before checkout. Plan limits, features, and pricing may change with notice before renewal where required.
- Customers may cancel through the billing portal. Cancellation normally takes effect at the end of the current paid period unless the checkout terms, applicable law, or an approved refund require otherwise.
Service changes and availability
- GrowthProof may modify the service to improve security, comply with law, or change product functionality. Material reductions to paid functionality will be communicated when reasonably practicable.
- The service is provided on an 'as available' basis. GrowthProof does not promise uninterrupted or error-free operation and may perform maintenance or suspend unsafe activity.
- GrowthProof and its payment or infrastructure providers may not support every country. Customers must not use the service where doing so is prohibited by applicable trade, sanctions, export-control, or other law.
- Third-party services including Supabase, Vercel, Cloudflare, Google, Lemon Squeezy, Resend, Loops, Sentry, and PostHog may affect availability and are subject to their own service terms.
Disclaimers and liability
- To the maximum extent permitted by law, GrowthProof disclaims implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
- To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the service.
- GrowthProof's aggregate liability arising from the service will not exceed the amount paid for the service during the 12 months before the event giving rise to the claim, except where applicable law does not allow that limitation.
Termination and general terms
- Customers may stop using the service at any time. GrowthProof may terminate or suspend access for material breach, unlawful use, security risk, or non-payment, subject to any notice required by law.
- After cancellation or termination, access and deletion follow the Refund and Cancellation Policy and Privacy Policy. Provisions concerning payment, confidentiality, intellectual property, liability, and disputes survive where their nature requires.
- These Terms and any dispute are governed by the laws of Bangladesh, without regard to conflict-of-law rules, unless a separately executed agreement states otherwise.
- If part of these Terms is unenforceable, the remaining provisions continue. Failure to enforce a provision is not a waiver, and obligations may be assigned as part of a merger, financing, reorganization, or sale of the business.
